By accessing and using this domain appraisal service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. dotappraisals reserves the right to modify these Terms at any time without prior notice. Your continued use of the service following any modification constitutes your acceptance of the revised Terms.

2. Description of service

We provide professional domain name evaluations based on current market trends, historical data, and human expert analysis. These evaluations are opinions of value as of the date the appraisal is issued and do not guarantee a sale price. dotappraisals has no obligation to update any appraisal to reflect subsequent market changes. The service does not constitute legal, financial, investment, or any other form of professional advice, and should not be relied upon as such.

3. Fees and payments

All fees for appraisals are due at the time of order through our secure payment processor (Stripe). All sales are final. No refunds will be issued once an appraisal has been initiated by our expert team. The sole exception is our money-back guarantee program, which operates exclusively under the specific conditions set forth on our Guarantee page. No other refund mechanism exists.

4. Intellectual property

The final appraisal report is licensed for your personal or business use only. You may share the report with prospective buyers or partners, but you may not resell the service, sublicense the report, or use our brand or reports to authorize or imply endorsement of third-party appraisals. All content, branding, methodology, and scoring frameworks remain the exclusive intellectual property of dotappraisals.

5. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE VALUATIONS PROVIDED WILL REFLECT THE FINAL TRANSACTION PRICE OF ANY DOMAIN. DOMAIN MARKETS ARE VOLATILE AND SUBJECT TO INDIVIDUAL BUYER DISCRETION. DOTAPPRAISALS EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY ARISING FROM YOUR RELIANCE ON ANY APPRAISAL REPORT.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOTAPPRAISALS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR ANY BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY APPRAISAL REPORT, EVEN IF DOTAPPRAISALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO DOTAPPRAISALS FOR THE SPECIFIC APPRAISAL GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless dotappraisals and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or reliance on any appraisal report; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any dispute between you and a third party in connection with a domain transaction in which an appraisal report was referenced.

8. Dispute resolution and governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

9. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between you and dotappraisals regarding the service and supersede any prior agreements.
